Scope

In accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG), this privacy policy is intended to inform the users of this website about the type, scope and purpose of the collection and use of personal data by the website operator onoff Aktiengesellschaft. The website operator takes your data protection very seriously and treats your personal data confidentially and according to the legal regulations. Keep in mind that data transmission over the internet may involve gaps in security. Complete protection against access by third parties is not possible.

Access Data

The website operator or page provider collects data about access to the site and stores it as server log files. The following data is logged in this way:

  • Amount of data sent in bytes
  • Source/link from which you reached the site
  • Browser used
  • Operating system in use
  • IP address used
The data collected is only used for statistical analysis and to improve the website. The purpose of creating the web server log files is to ensure the functionality of the website. The website operator has a legitimate interest in collecting this data in accordance with Art. 6 para. 1 lit (f) GDPR. However, the website operator reserves the right to subsequently check the server log files if there are concrete indications of illegal use. The server log files are deleted after 180 days.

Indeed Conversion Tracking

This website uses a web analytics tool from Indeed (Indeed Ireland Operations Ltd., 124 St. Stephen’s Green, Dublin 2, Ireland). For the analysis of the use of the website, certain usage data transmitted by your browser is collected and evaluated by Indeed. Leadec Holding BV & Co. KG receives a statistical evaluation of the number of referrals of potential applicants through Indeed. To collect this usage data, Indeed may use one or more cookies. In addition, the IP address assigned to your device at the relevant time and a browser-specific identifier are transmitted. The IP address is required solely for the purpose of session identification and geolocation (down to city level). The cookie loses its validity after 30 days, and after 30 days the session ID can no longer be accessed. This session ID makes it possible to record which job ads you have clicked on within a page visit. The legal basis is our legitimate interest (Art. 6 para. 1 lit.(f) GDPR) in using this data to evaluate and improve the design of our job advertisements. Applying for a Position

Regardless of whether an application is made by email, via a contact form or a job advertisement, on Indeed or by mail, as part of the application process we process your personal data, which usually comprises name, address, email, and telephone number as well as any comments and file attachments that you may include. The processing is carried out for the purpose of contacting you and assessing your suitability for the position for which you are applying. The legal basis is Section 26 (1), (8) sentence 2 BDSG or Section 26 (2), (8) sentence 2 BDSG.

Handling of Contact Information

If you contact the website operator through the contact options offered, your details will be stored so that they can be used to process and answer your request. We will forward your request according to your requirements to the appropriate company of the onoff Group, if applicable. If you have a contractual relationship with us or are interested in our services, the legal basis of the processing is Art. 6 para. 1 lit. (b) GDPR. Otherwise, the legal basis of the processing is our legitimate interest in providing contact options in the context of our business operations (Art. 6 para. 1 lit.(f) GDPR).

Ordinary Contact in the Course of Business (e.g., a trade fair)

In cases where contact data is exchanged during spontaneous interactions, such as with the exchange of business cards at trade fairs, events, business lunches or other official activities, we process your contact data (name, address, email or telephone number), data on your company (address, field of business, job description, title), data on your submission/inquiry (content, time of inquiry, means of communication) in order to get back in touch with you and process your inquiry. The legal basis is Art. 6 para. 1 lit. (f) GDPR.

Links to Social Networks

Our website includes links to social networks (Facebook and LinkedIn as well as Xing and Kununu). These services are operated exclusively by third-party providers. Joint Accountability with Facebook

We are jointly responsible with Facebook Ireland Ltd. for the collection (but not the further processing) of data of the visitors of our Facebook page https://www.facebook.com/onoffag/. This data includes information about the types of content users view or interact with, or the actions they take, as well as information about the devices users use (e.g., IP addresses, operating system, browser type, language settings, cookie data). The legal basis for data processing is our legitimate interest in ensuring that our offerings and our company are present on the internet as comprehensively as possible, as well as the possibility of communicating with you via social networks (Art. 6 para. 1 lit. (f) GDPR). Facebook also collects and uses information to provide analytics services, called “Page Insights,” to page operators to provide them with insights into how people interact with their pages and with associated content. We have concluded a special agreement with Facebook in accordance with Art. 26 GDPR. The rights of users (in particular to information or to erasure, objection and complaint to the competent supervisory authority), are not restricted by the agreements with Facebook. You can assert your rights (information, rectification, erasure, restriction of processing, data portability, objection and complaint) both against us and against Facebook. Transfer of Personal Data to Third Parties and to Countries Outside the EEA

Your personal data will only be transferred to third parties if this is permitted by law or if you have previously given consent. For example, we may transfer data to other companies in the onoff Group. We will only pass on your data to state authorities within the scope of legal obligations or on the basis of an official order or court decision. A transfer to recipients outside the EU only takes place as described under the sections on Google Analytics and Facebook.

Duration of Storage

We delete your personal data as soon as they are no longer required for the above-named purposes of processing.

Rights of the User as Data Subject

Upon request, you as a user will receive free information on what personal data about you has been stored (Art. 15 GDPR). In accordance with Art. 16 GDPR, you have the right to rectify incorrect data. Unless your request conflicts with a legal obligation to retain data, you have a right to block/restrict (Art. 18 GDPR) or erase (Art. 17 GDPR) your personal data. Please send your request to datenschutz@onoff-group.de. If you have provided this data, you can request to receive and transmit it (Art. 20 GDPR).

In addition, in case of processing based on Art. 6 para. (1) lit. (f) GDPR, you may object to the processing (Art. 21 GDPR), in which case you must provide a specific reason.

If the processing is based on consent within the meaning of Art. 6 sentence 1 para. 1 lit. (a) GDPR, you may revoke this consent at any time for the future (Art. 7 para. 3 GDPR). You also have the right to contact the competent data protection supervisory authority (Art. 77 GPDR). Decision making is not carried out by automated means.
